Probate and Letters of Administration

Probate (also known as the ‘grant of probate’) is a set of legal documents, issued by the Supreme Court of Victoria, which empowers the executor of the Will to deal with the Estate in accordance with the Will.

Kenney Legal can assist clients in applying for probate in circumstances of a formal, and informal Will.

In circumstances where a deceased person did not leave a Will a client can apply for a Grant of Letters of Administration. Letters of Administration allow a person (usually the deceased’s spouse or other immediate family member) to access the money, property and other assets of the deceased and pay their remaining liabilities.

Letters of Administration can be problematic and difficult to obtain, however Kenney Legal can assist clients in this process.

When there is a challenge to a Will, or a belief that you have not been adequately provided for, Kenney Legal can assist in bringing a claim for you against the Estate. This can be in the form of a claim against the Estate or a Family Provision Claim.

Hourly Fees

Professional fees for Probate and Letter of Administration matters are billed at our hourly rate. If you require assistance distributing the Estate post the granting of probate, Kenney Legal can provide a fixed fee quote reflective of the assets within the estate.
